RIGHT OF RETRACTION

In accordance with the law, the Customer has a period of retraction of 7 days from the date of receipt of the package, to retract for any reason.

The Customer can return his Product to Ken Okada Paris by La Poste. The return costs via La Poste are at the responsibility of the Customer, except if a Product is defective at receipt or if an error occured when sending the Product, in which case the return costs will be refunded to the Customer by KEN OKADA PARIS.

KEN OKADA PARIS undertakes to reimburse the Customer who exercised his right to retract, the sums dued, as soon as possible and at the latest within thirty (30) days following the exercise of the right of retraction.

KEN OKADA PARIS will refund the Customer of the returned Products subject to compliance with the conditions mentioned above.

In case of exchange, the Client has also a period of 7 days to request an exchange.
The Customer then will not have to pay La Poste return fees.

  • Article L211-4 of the french 'Code of Consumption': The seller is obliged to deliver goods that are conform to the contract and is responsible for defects of conformity existing at the time of sending the delivery. The seller is also responsible for the defects of conformity resulting from the packaging, the assembly instructions or the installation when this installation was charged to him by the contract or was carried out under his responsibility.
  • Article L211-5 of the french 'Code of Consumption': To comply with the contract, the good must:

1) Be fit for the usual expected use of a similar good and, where applicable:

  • match to the description given by the seller and possess the qualities which he has presented to the purchaser in the form of a sample or a model;
  • present the qualities that a buyer can legitimately expect in relation of public statements made by the seller, the producer or his representative, in particular in advertising or labeling;

2) Or present the characteristics defined by mutual agreement by both sides or be specific to any special purpose sought by the buyer, brought to the knowledge of the seller and which the latter has accepted.

- Article L211-12 of the french 'Code of Consumption': The action resulting from the lack of conformity is prescribed by two years from the delivery of the good.

- Article 1641 of the french 'Civil Code': The seller is liable for the hidden defects of the good sold which render it unfit for the use for which it is intended for, or which such decrease this use, that the purchaser would not have acquired it, or would have given a lesser price if he had known of them.

- Article 1648 paragraph 1 of the french 'Civil Code'The action resulting from the crippling defects must be brought by the purchaser within two years from the discovery of the defect.
